The Nurse's Role Regarding Consent Forms

Nurses are often asked to obtain consent forms.  The nurse is not responsible for explaining the procedure.  The nurse is only responsible for witnessing the client's signature on the form.  The nurse's signature confirms:

  • Client gave consent voluntarily
  • Signature is authentic
  • Client appears competent to give consent

The nurse must verify that the client received enough information to give consent.  She should ask if there are any questions.  If the nurse doubts about the client's understanding, the nurse must notify the health provider who will be performing the procedure.

At no time does a nurse explain the medical or surgical procedure.  A nurse could be liable for giving incorrect or incomplete information or interfering with the client-provider relationship. 

The nurse only a witness to the client's signature on the consent form.
